Why we process it

Scope and communication

Before work begins, we aim to define the scope of the engagement, identify the responsible advocate, record relevant assumptions or limitations and issue an engagement letter. During the matter, we provide proportionate updates, explain legal issues in accessible language and notify clients of material developments or risks.

How fees are structured

Fees are determined in accordance with the Advocates Act, the Advocates Remuneration Order and applicable professional standards. Depending on the instruction, arrangements may include fixed fees for defined work, hourly rates, transaction-based fees or retainers for continuing advice.

Estimates, disbursements and billing

Where practicable, we provide an indicative estimate at the outset and explain significant changes. An estimate may change if the scope or complexity changes. Clients are responsible for agreed disbursements such as filing fees, stamp duty, registration fees and third-party professional charges. Invoice timing, payment terms, deposits and any permitted interest on overdue amounts are set out in the engagement terms.

Conflicts, files and termination

We maintain procedures to identify and manage conflicts of interest. We retain secure records for periods required by law, regulation and risk-management considerations. Either party may terminate an engagement in accordance with the engagement letter, subject to outstanding fees and applicable professional duties.

Raising a concern

Unresolved complaints may be referred to the Advocates Complaints Commission or the Law Society of Kenya’s Disciplinary Tribunal where applicable.
